Returns
There are no returns, cancellations exchanges or warranties currently accepted on art purchases. Purchases are FINAL as this is a small business and we work hard to stock, ship and serve you as a sole individual run business.
Nicole Irvine /Nicolespaintescape is not responsible for :
- Damage caused by shipping handlers or customers.
- Lost and or stolen items.
- Injury caused by handling your item in any form or manner.
- Art that has fallen due to hanging or otherwise.
- Property damage as a result of Art falling or otherwise.
- Art that has been placed in an extremely hot environment or direct sunlight and has (in extremely rare cases) softened, run, or yellowed. Extreme heat may alter resin and its compound and it may soften or yellow. It is the responsibility of the buyer to treat the art with care.
- Placement of identification of the art business such as signature or otherwise. Should the buyer not like these details, and request a refund after the fact, this will be ignored. The artist retains to right to probably brand her art.
- DIMENSIONS - PLEASE NOTE - the x1 at CHECKOUT refers to your order of x (how many items) NOT DIMENSIONS. Please refer to the item dimensions for measurements. We WILL NOT offer refunds for the misreading of your items dimensions or mistaking your inventory count for the item measurements!
Comissioned / Custom orders - No refunds are accepted on custom orders. CUSTOM orders require a 50% NON refundable deposit to cover your art and the materials. Should the buyer cancel their order after the deposit is paid; they will forfeit their ordered piece to cover expenses and now market an item that was custom tailed to their wishes. This may be difficult for the artist to sell such an item, no exceptions to refunding will be made as a result.
In the unlikely event art arrives damaged after shipping:
We will require a photo of the damage WITHIN the packaging to observe what possibly occurred. This is highly unlikely as we take the utmost care in packaging, however we cannot guarantee the handling of art once in the hands of the shipper. Art that has been tampered with or damaged post shipping, ex. during the hanging process WILL NOT BE REFUNDED. A photo must be sent with the item still inside the original packaging as well as of the packaging within 48 hours.
There are disclaimers placed on all art stating care and handling of art, as well as placement and hanging of art. Nicole'spaintescape will not be held liable for damages, injury or otherwise incurred for handling your art/items.
Please note we take all possible measures to protect your art from rough transit, however we cannot accept responsibility for ill treatment while in transit. Paintings will be packed securely and should be able to withstand a 4 foot drop and we package art in consideration of these factors.
Should this happen, we will discuss with you how we will go about replacing the damaged piece. The buyer will be required to return the damaged piece 15% of the original purchase price will be non refundable for handling of the damaged piece, as well as the original shipping cost.
Nicole's Paint Escape will not be held liable for any in transit damage or poor handling, or damage or injury due to and /of mishandled art that is not hung properly, or claims of injury due to materials used on the art itself. Art may have textured materials such as glass, crystal, shell or sand that may be sharp or rough to the touch. Handling care is provided on item descriptions on the website.
Transit Issues:
Route insurance is provided and included in all shipping charges and quotes. Due to the value of most art pieces, this option is built in should an event of damage or loss occur.
Nicole'spaintescape works hard to ensure timely delivery, however unpredictable events do and can occur that the buyer must consider we do not have control over. Nicole'spaintescape will provide the courier provider and tracking at the time of purchase, should an event arise, the buyer is to contact that courier provider directly with their tracking information to navigate the problem. Nicole'spaintescape can and will also assist, however the courier speaking directly to the receiving person is often requested.
Should a loss or event occur, a claim may be needed and the buyer MUST make Nicole'spaintescape aware of this within:
5-7 business days of the original shipping date recorded per the courier for domestic shipping,
10-12 business days of the original shipping date for international shipping. A claim option is only for insured and tracked items, should the buyer opt out, there will be no consideration of replacement, refund or exchanges.
Stolen Items- reported as Delivered
Any item reported missing or possibly stolen over $100 CAD must be filed and reported within 4-7 business days from when the item was delivered. Stolen items will require the provision of a Police Report as well as all original tracking and insurance information. The buyer must take initiative to start THEIR OWN CLAIM WITH THEIR COURIER. Keep the tracking information that is sent to you via receipt upon final transaction.
Damage-
Transit may experience rough travel and we take all care to ensure it can withstand the unpredictability of rough transit. Should your box/package arrive damaged, inspect the packaging, take photos PRIOR TO OPENING **this will be needed to file a claim with your courier**and then carefully unpackage and inspect your item. The photos of the damage must be with the item in the original packaging, as well as a photo of the original packaging ITSELF.
Textured pieces are used often for the 3d elements of this art; sand, shells, crystal and glass may have shaken loose or come off during transit. This is to be expected at times and we can guide you on how to affix or correct a large piece that may have shaken loose! There are ways to correct minor damage, we can always assist on this.
Once a product has shipped,, it is no longer the responsibility of Nicolespaintescape for damages incurred, handling, loss or theft of the item. Contact your courier for claims should damage or theft occur.
Ensure all entered information for delivery is precise and correct! Products delivered to the wrong address due to driver error or mis-entered information is not the responsibility of Nicolespaintescape. Contact your courier should this occur.
Packages returned due to any of the above will incur more shipping charges or possibly loss at the expense of the purchaser.
Non-Returnable Items
Nicolespaintescape will not accept returns of perishable goods (food, flowers, plants, or otherwise) personal care items, personalized special order items, beauty products, health products or health improvement items, drugs or medicinal items, illegal items, or illegal substances. No returns are accepted for hazardous materials, flammable liquids, or gases.
Hanging/Handling your Artwork
Nicolespaintescape/Nicole is not liable for any damages or injuries that may incur from the handling/mishandling or improper hanging of any and all artwork. We strongly suggest you get a professional with the equipment and the proper hanging fittings to safely and securely place your art for the environment and all natural events you may face that could effect said placement of your artwork. Any damages incurred during removal of the artwork from shipping packaging is not accountable or to be held liable on behalf of the artist; it is the customer's duty to safely remove and store all purchased artwork.
PAYMENTS/DEPOSITS/Branding/Signatures/Insignia

The buyer agrees that their item will not be shipped until the final payment has cleared and only upon payment clearing will their item be shipped. Shipping time is not included or subject to the waiting time of fund transfer and payment receival.
- Should weather be extreme in temperatures, the artist reserves the right to delay shipping to keep the integrity of art items intact.
- Holds and Deposits - Deposits will be taken for ANY hold requested of any art item. Should the buyer change their mind /withdraw their desire for the item at the end of the holding period, the artist retains the right to withhold 10% of the original deposit for any Shopify incurred fees and restocking. The buyer will allow for up to 14 business days to receive their refund.
- Art Labelling/Identification/Branding or Artist signature - The artist retains the RIGHT to mark her artwork as deemed suitable by the artist. Any dispute over the way the artwork is marked or branded - including art where a deposit has been retained, will not result in a deposit retainer being returned or the art amount in agreement in sale/deposit/ or therewithin being refunded. The artist reserves the right to mark art items without discussion as to placement with the buyer should it be an inventory purchase. Comission pieces may be discussed in terms of signature and branding placement, should the piece have been created from first steps with the buyer.
